This Privacy Policy explains how Angel Delivery (AU) Pty Ltd, trading as Angel Delivery Australia (“Angel Delivery”, “we”, “us” or “our”), collects, holds, uses and discloses personal information.

We are committed to handling personal information responsibly and in accordance with applicable Australian privacy laws.

Section 1 — Information we collect and how we use it

Completing and delivering your purchase

When you purchase something from our store, we collect personal information needed to process and fulfil your order. This may include:

  • Your name, email address, telephone number and billing address
  • The recipient’s name, telephone number and delivery address
  • Delivery instructions
  • Your order and transaction details
  • Gift-card messages or information you choose to provide
  • Communications you have with our customer-service team

We use this information to:

  • Process payment and complete your purchase
  • Prepare, fulfil and deliver your order
  • Communicate with you about your order
  • Contact the recipient where reasonably necessary to complete delivery
  • Provide customer service and resolve problems
  • Prevent fraud and protect the security of our website
  • Meet our legal, accounting and record-keeping obligations

Please only provide personal information about another person, such as a gift recipient, where you are authorised to do so or where it is reasonable in the circumstances.

Abandoned checkouts

Where you begin placing an order but do not complete it, we may use the email address or telephone number you provided to send you a reminder about your incomplete checkout where you have consented to receive this communication or where otherwise permitted by law.

You can unsubscribe from these communications using the link or instructions included in the message.

Website and device information

When you browse our website, we and our service providers may automatically collect information such as:

  • Your internet protocol address
  • Browser and device type
  • Operating system
  • Pages viewed and links selected
  • Referring website
  • Approximate location
  • Dates and times of website activity
  • Cookie and advertising identifiers

We use this information to operate and secure our website, understand how customers use it, improve our services and measure the effectiveness of our advertising.

Email and SMS marketing

Where you have consented, or where otherwise permitted by law, we may send you emails or text messages about our products, services, promotions and other updates.

Our marketing messages will identify Angel Delivery as the sender and include a way to unsubscribe. You can withdraw your consent at any time by following the unsubscribe instructions in the message or contacting us.

We do not automatically add gift recipients to our marketing lists merely because they have received a gift.

Australian commercial electronic messages generally require consent, sender identification and a functioning unsubscribe method.

Personalised advertising and remarketing

We may use cookies, tracking technologies and selected customer information to measure advertising and show more relevant advertising through platforms such as Google and Meta.

This may involve securely sharing identifiers, such as a hashed email address or telephone number, with advertising platforms to:

  • Reach existing customers
  • Measure advertising performance
  • Show advertising to people who may be interested in our products
  • Create similar or “lookalike” audiences

We will only use personal information for this purpose where we have an appropriate legal basis and where the use is consistent with your reasonable expectations, consent and applicable law.

We do not use a gift recipient’s contact details for personalised advertising or audience matching merely because they have received a gift.

You can contact us to request that we stop using your personal information for direct marketing.

Australian privacy guidance requires organisations using tracking technologies for targeted advertising to consider direct-marketing obligations and provide a simple way to opt out.

Gifts and surprises

From time to time, we may send existing customers a small gift or surprise by post as part of our customer-care programme.

We will only use your postal address for this purpose where reasonably expected, consented to or otherwise permitted by law. You can opt out at any time by contacting us at hello@angeldelivery.com.au.

We will not send promotional gifts to gift recipients unless we have an appropriate basis to do so.

Section 2 — Consent and your choices

How do you obtain my consent?

When you provide personal information to place an order, make a payment, arrange delivery, contact us or request a return, we collect and use that information for those purposes and related business activities.

Where consent is required for a separate purpose, such as email or SMS marketing, we will ask for your consent or provide an appropriate choice.

Consent may be express or implied depending on the circumstances and applicable law. We will not treat silence or inactivity as consent where express consent is required.

How do I withdraw my consent?

You can withdraw your consent to marketing or request that we stop using your information for direct marketing at any time by:

  • Following the unsubscribe instructions in an email or text message
  • Updating your cookie or privacy preferences
  • Emailing us at hello@angeldelivery.com.au
  • Writing to us at 145 Martin Street, Brighton, 3186, VIC

Withdrawing consent will not affect processing that has already occurred lawfully. We may still retain and use information where necessary to fulfil an order, comply with legal obligations, resolve disputes or protect our legal rights.

Section 3 — When we disclose personal information

We may disclose personal information to third parties where reasonably necessary to operate our business, fulfil your order or comply with the law.

These third parties may include:

  • Shopify and website-hosting providers
  • Payment gateways and payment processors
  • Delivery drivers, couriers and logistics providers
  • Email and SMS service providers
  • Cloud-storage and information-technology providers
  • Customer-support and business-management platforms
  • Analytics, advertising and social-media platforms
  • Professional advisers, insurers and auditors
  • Government, regulatory or law-enforcement bodies where required by law

We may also disclose information:

  • With your consent
  • To investigate suspected fraud, misuse or unlawful activity
  • To enforce our Terms and Conditions
  • Where necessary to protect our rights, customers, staff or the public
  • In connection with a business sale, merger, restructure or acquisition

We require service providers to handle personal information only for the purposes for which it was provided and in accordance with applicable contractual and legal obligations.

Section 4 — Shopify and payments

Our online store is hosted by Shopify. Shopify provides the e-commerce platform that allows us to sell products and services to you.

Information may be processed and stored through Shopify’s systems and those of Shopify’s service providers. Shopify may also collect and process information in its own capacity, including when customers use services such as Shop Pay.

Payments are processed through Shopify Payments or another payment provider available at checkout. Payment providers may collect payment-card and transaction information directly from you.

Angel Delivery does not ordinarily receive or store your complete payment-card number. Payment information is handled by the relevant payment provider in accordance with its privacy policy and applicable payment-security standards.

Shopify states that stores powered by Shopify are PCI DSS compliant.

You can find more information in Shopify’s Consumer Privacy Policy and the privacy policy of the payment method you select.

Section 5 — Third-party services and overseas disclosure

Third-party providers generally collect, use and disclose personal information to the extent necessary to provide their services to us. These providers may also handle personal information in accordance with their own privacy policies.

Some service providers may be located outside Australia or may store or process information in other countries. As a result, your personal information may be subject to the laws of those countries.

The countries in which our service providers are likely to store or process personal information may include:

  • Australia
  • New Zealand
  • United States
  • Canada

You should confirm this list against the actual providers and apps used by the Australian Shopify store.

Where required, we take reasonable steps to ensure overseas recipients handle personal information consistently with applicable Australian privacy requirements. Australian Privacy Principle 8 addresses the protection of personal information disclosed overseas.

Delivery providers

We may provide the information reasonably required to deliver your order to our delivery drivers, courier companies or logistics providers.

This may include:

  • Customer and recipient names
  • Delivery address
  • Telephone numbers
  • Email address
  • Delivery instructions
  • Relevant order information

The delivery provider may use these details to send delivery notifications, contact the customer or recipient, confirm delivery or respond to an unsuccessful delivery.

Replace this section with the name of your delivery provider only where you have confirmed which provider will be used. Do not retain the New Zealand Post wording on the Australian website.

Third-party links

Our website may contain links to third-party websites or applications. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with personal information.

Section 6 — Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

These steps may include:

  • Access controls
  • Password and account-security measures
  • Encryption
  • Secure service providers
  • Staff confidentiality requirements
  • System monitoring and updates
  • Secure disposal or de-identification where information is no longer required

No method of transmission or electronic storage is completely secure, and we cannot guarantee absolute security.

We retain personal information for as long as reasonably necessary to fulfil the purposes described in this policy, comply with legal and accounting requirements, resolve disputes and protect our legal rights.

When information is no longer required, we take reasonable steps to destroy it securely or permanently de-identify it, subject to our legal obligations.

Australian Privacy Principle 11 requires covered organisations to take reasonable steps to protect personal information and consider whether it remains permissible to retain it.

Cookies and tracking technologies

We use cookies and similar technologies to:

  • Operate our online store and shopping cart
  • Keep the website secure
  • Remember customer preferences
  • Understand website usage
  • Measure website and advertising performance
  • Personalise content and advertising where permitted

Some cookies are necessary for the website to function. Others may be provided by analytics, advertising, social-media or other service providers.

The cookies used by Shopify and installed applications can change over time. For this reason, we do not list individual cookie names and expiry periods in this policy.

You can control cookies through:

  • Your browser settings
  • Our cookie-preference tool, where available
  • Privacy settings offered by advertising and analytics providers

Disabling certain cookies may affect how the website operates.

Shopify provides customer-privacy controls that merchants can configure for cookie banners and privacy preferences.

Section 7 — Children’s privacy

Our website and products are intended for adults who are legally able to place an order.

We do not knowingly collect personal information directly from children for marketing purposes. Where a person under 18 uses the website, they should do so with the involvement of a parent or guardian.

If you believe a child has provided personal information to us without appropriate permission, please contact us.

Section 8 — Accessing and correcting your information

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

You may also ask us to delete information. We will consider deletion requests, but may need to retain certain information for legal, accounting, fraud-prevention, dispute-resolution or operational purposes.

To make a request, contact us at hello@angeldelivery.com. We may need to verify your identity before acting on the request.

We will respond within a reasonable period. If we refuse a request, we will explain the reason where required by law and tell you how you may make a complaint.

Section 9 — Privacy complaints

If you believe we have mishandled your personal information, please contact us using the details below and provide enough information for us to understand and investigate your concern.

We will acknowledge your complaint and aim to respond within a reasonable period.

If you are not satisfied with our response, you may be entitled to contact the Office of the Australian Information Commissioner.

An Australian privacy policy should explain how individuals can access or correct their information, lodge a privacy complaint and how that complaint will be handled.

Section 10 — Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices, services, technology or legal obligations.

The updated policy will take effect when it is published on our website. The “Last updated” date at the top of this page will show when the policy was most recently changed.

Where changes are material, we may also provide additional notice through our website or other appropriate channels.

If our business is sold, merged, restructured or acquired, personal information may be transferred as part of that transaction, subject to applicable law.
